Welcome to Favours and Frosting. We are based in Scotland and operate this website through Wix. By making an enquiry, confirming an order, or otherwise using our website, you agree to the following terms and conditions.

Definitions

we”, “our”, “us” refers to Favours and Frosting.

you”, “your”, “customer” refers to any visitor, user, individual, or organisation making an enquiry, placing an order, or using this website.

  1. General

    • These terms apply to all enquiries and orders placed directly with us, whether through our website, by email, or in person.

    • We reserve the right to update these terms at any time. The version published on our website at the time your order is confirmed will apply.

    • If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

  2. Enquiries & Orders

    • An order is considered confirmed only when we have verified the date, availability, pricing, and collection or delivery arrangements, and issued a written order confirmation.

    • Some products (such as bespoke cakes or wedding favours) may require a deposit to secure your booking.

  3. Prices & Payment​

    • All prices are listed in GBP (£) and include VAT, where applicable.

    • As our online store is not yet available, all payments are processed manually by arrangement at the time of confirmation.

    • Prices shown on our website or price guide represent starting prices only and may vary depending on design, decoration, flavour selection, and other custom details.

    • Non-event orders (e.g. standard cakes, boxes of tablet, or other gifts) are non-refundable once payment has been received, except where required by statutory rights.

    • Event orders (e.g. wedding favours, celebration cakes) are subject to the payment and cancellation terms outlined in Section 5.

  4.  Collection & Delivery​

    • Collection is available from our premises by prior appointment.

    • Local delivery may be available upon request and subject to an additional charge.

    • We take care to ensure all products are packaged appropriately for safe transport but cannot be held responsible for any damage once items have left our premises or been collected by a courier.

  5. ​Event Orders: Deposits, Payments & Cancellations

    • A 25% deposit is required to confirm your booking. This deposit secures your date and is refundable only if you cancel within the 14-day cooling-off period following confirmation.

    • After the 14-day cooling-off period, deposits become non-refundable.

    • If your event date falls within 14 days of ordering, you agree to waive the cooling-off period, and full payment is required at the time of booking.

    • The remaining balance is due 12 weeks before the event date, unless otherwise stated in your order confirmation.

    • If you cancel your order:

      • More than 12 weeks before the event: your deposit will be retained, but any additional payments will be refunded.

      • 12 weeks or less before the event: no refund will be given.

    • C​ustomers are advised to take out event insurance to cover unforeseen cancellations.

    • In exceptional circumstances, we may need to cancel an order or booking. In this case, all monies paid (including deposits) will be refunded in full.

  6. ​Allergies & Dietary Information

    • All products are made in a home kitchen that handles dairy, gluten, eggs, nuts, and other allergens.

    • While every effort is made to avoid cross-contamination, we cannot guarantee that any product is free from traces of allergens.

    • Customers are responsible for notifying us of any allergies and ensuring our products are suitable for their needs before ordering.

  7. ​Returns & Refunds

    • As all our products are handmade and perishable, we are unable to accept returns.

    • If your order arrives damaged or incorrect, please contact us within 24 hours of collection or delivery and include photographs where possible. We will review and, at our discretion, may issue a replacement or partial refund.

  8. ​ Liability

    • Our liability to you for any claim (whether in contract, tort, or otherwise) will not exceed the total amount paid for the goods in question.

    • We will not be liable for any indirect or consequential losses, including loss of enjoyment, profit, or goodwill.

    • If we must cancel an order, our liability is limited to refunding all amounts paid for that order.

    • Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.

  9. ​Website Use

    • This website and its contents are provided for general information and inspiration.

    • All written content, branding, and original photography are the property of Favours and Frosting and may not be reproduced without permission.

    • Some stock images and design elements are used on this website for illustrative purposes. These remain the property of their respective copyright owners.

    • Our website is built using the Wix platform, and use of this site is also subject to Wix’s own Terms of Use. Please see our Privacy Policy for more information on how we handle personal data.

    • We make every effort to ensure that information, descriptions, and pricing displayed are accurate; however, minor variations or updates may occur without notice.

  10. ​Governing Law

    • These terms are governed by the laws of Scotland.

    • Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
